Infringement Claims, DMCA Policy

Information on how to submit claims of copyright and trademark infringement.

If you believe that your copyrighted work or trademark has been used in a way that constitutes copyright or trademark infringement and is accessible via one of QuantumForce’s services, please notify QuantumForce’s agent, as set forth below.

Summary of the Process

  1. If anyone believes that material on a QuantumForce-hosted website or service infringes their copyright or trademark rights, that person may send us a written notice as described below.
  2. If we receive a valid notice, we will remove or disable the allegedly copyright-infringing material.
  3. We will attempt to notify the user who posted the allegedly infringing material by sharing the notice with them. That user then has the right to request that the material be re-enabled. If they properly make such a request, we will re-enable the material unless and until the two parties jointly ask us to remove it or a court orders us to remove it.

Who Should Contact Us, Contacting the User, Misrepresentations

  • Only the owners of a copyright or trademark (or the authorized representative of the owner) can report a suspected infringement to us.
  • If you are not the owner (or the authorized representative of the owner), you cannot report a suspected infringement to us.
  • If you believe that any content on a website infringes another party’s copyright, you should advise the copyright owner directly.
  • We strongly urge you to contact the user directly.
  • You may be liable for damages, including court costs and attorneys’ fees, if you materially misrepresent that content on a website is copyright infringing.

When in doubt, you should consult an attorney.

Required Information for Your Notice

We require the following details in your notice, in line with the DMCA:

  1. Your Copyright or Trademark: Sufficient detail about the copyrighted work or trademark that you own or represent.
  2. Allegedly Infringing Material: The URL or specific location of the infringing material.
  3. Statement of Good-Faith Belief: Example: “I have a good-faith belief that use of the materials described above as allegedly infringing is not authorized by the owner, its agent, or the law.”
  4. Truthfulness & Ownership Statements: Example: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright/trademark owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  5. Contact Information: Name, address, telephone number, and/or email address.
  6. Signature: An electronic or physical signature.

How Will QuantumForce Respond?

After we receive a valid written notice, we will expeditiously remove or disable the allegedly infringing content, notify the uploader, and may take further steps including termination for repeat infringers.

Restoration of Removed Content

If a user believes their content was removed by mistake or misidentification, they may send us a counter-notification with the following:

  1. Identification: Material that has been removed or disabled and its URL.
  2. Consent to Jurisdiction: Example: “I consent to the jurisdiction of the Federal District Court with jurisdiction in [city/state] or San Francisco, CA if outside the U.S., and I will accept service of process from the person who provided notification of infringement or an agent of such person.”
  3. Statement of Good-Faith Belief: Example: “I swear, under penalty of perjury, that I have a good-faith belief that each search result, message, or other item of content identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
  4. Contact Information: Name, mailing address, telephone number, and email address.
  5. Signature: The user’s physical or electronic signature.

In line with the DMCA, following receipt of a valid counter-notice, we may restore the removed or disabled content after 10 business days unless our copyright agent receives notice that a court action has been filed.
